My office can assist and provide representation when an individual or professional fiduciary is seeking to establish a conservatorship. Once established, we can provide ongoing advice and assistance with the required documentation and court mandates to assist our clients with the continuing performance of their duties as Conservators.
To begin, we prepare and file for the initial Conservatorship or to contest the appointment of a Conservator who is undesired with our client. Once a Conservatorship is established, we assist our clients in the continuing performance of their duties . These documents may include the initial Petition for Appointment of Conservator of the Person and/or Estate, the following Accountings, Petitions for Instructions, Fees, Petitions for Substituted Judgment to prepare a new or revised estate plan, Petitions for Termination and Distribution and Petitions for Removal of a Conservator.
A Probate Conservatorship is a formal court proceeding during which a judge is asked to and can appoint a person, a Conservator, to care for another adult, the Conservatee, who cannot manage their finances and/or their own personal care, and health care. This disability may be temporary or permanent and often occurs due to the aging process or as a result of injury, illness or other circumstances. The Conservator can be a friend or family member or a professional fiduciary can step in. If need be, we can help locate the appropriate Conservator.
Sometimes, an adult’s normal decision making can be overcome by the undue influence exerted over them by a caregiver, a neighbor or a family member, especially when they find themselves susceptible and isolated by life or circumstances. A Conservatorship can be vital in providing security, comfort and provide the proposed Conservatee with continuity and agency to live out their best life without unnecessary risk. A Conservatorship can also preserve assets for the life of the Conservatee and the legacy they want to leave for their true friends and family.
When an alternative to Conservatorship is advisable or necessary, we help our clients explore all other possible avenues for the protection of a vulnerable adult before proceeding with a Conservatorship. We can also help our clients avoid Conservatorships and help them to plan for their future personal and medical care and for the management of their finances with the appropriate estate planning documents, such as Trusts, Advance Health Care Directives and Durable Powers of Attorney.
If a Conservatorship is established, the duties and responsibilities of a Conservator in California law are extensive and usually demanding and we can assist throughout the conservatorship to insure those requirements are met including the required accountings, notices to the Court if an address is changed, oversee care and wage and hour issues, prepare an estate plan where necessary, and related Conservatorship documents.
